"Presentation" Text: Good evening. Today I have been asked to discuss patents. In the United States, Patents are issued by the United States government and are designed to protect a device that embodies a new or novel idea or principle. There are several types of patents. A Utility Patent protects any new and useful process, machine, method, or composition of matter. Utility patents currently have a term of 20 years from the earliest filing date. A design patent protects nonfunctional, new, and original ornamental design for a manufactured item-- such as the design of the iPhone, for example. Design patents have a term of 14 years from the date of issue. Patents are a type of intellectual property, and are subject to the Internal Revenue Code as intangible assets. As such, a patent is subject to capital gains treatment upon disposition and may be amortized over its life. Owning a patent gives you the right to stop others from manufacturing and selling the patented item. Please note that this demo does not constitute legal advice.
