These terms are an agreement between you and the developer of Saymondo, Cloud of Star Co., Ltd., called “Saymondo”, “we” or “us” in these terms. They apply to Saymondo from Google Play, to the version downloaded from https://www.saymondo.com and to the version for iPhone and iPad from Apple's App Store (the “version from the App Store”); section 16 explains which license applies to the app in the version from the App Store. In these terms, “phone” also means a tablet, such as an iPad. By installing or using Saymondo, you agree to these terms. If you do not agree, do not use the app. If you are not old enough to agree to terms like these where you live, a parent or guardian needs to agree to them for you.
Please read the parts in bold with particular care. They limit our responsibility (sections 2, 8 and 9), restrict how the offline voice may be used (section 4), explain that a subscription renews automatically until you cancel it (section 10), and limit the number of devices on which Saymondo Pro from a Saymondo account can be used (section 10.13).
1. What Saymondo is
Saymondo translates a spoken conversation between two people who are together. Each person holds a button and speaks; the app recognizes the speech, translates it, shows it on screen and can read the translation aloud. Once you have downloaded the models, recognition and translation run on your phone, and translations are read aloud by the offline voice pack, by your phone's text-to-speech engine or, on iPhone and iPad, by the voices built into iOS and iPadOS: using Saymondo for face-to-face translation never requires an internet connection or any server of ours. You can use Saymondo without an account; an optional Saymondo account lets you use Saymondo Pro on your other devices (section 11). You can use all of it free for 3 days and then translate up to 20 sentences a day free of charge; the optional Saymondo Pro subscription removes the daily limit (section 10). The privacy policy, at https://www.saymondo.com/privacy and in the app under Settings > About > Privacy policy, explains how the app handles information, including which optional features use the internet.
2. Translations can be wrong
Saymondo relies on machine speech recognition and machine translation, and both make mistakes. The app may mishear words, mistranslate, leave things out, add things nobody said, get names and numbers wrong, or sometimes produce text that is not a translation at all, such as an answer to a question. Voices may mispronounce words.
Do not rely on Saymondo where a mistake could cause harm, including medical care and medicines, legal matters, official procedures (such as police, immigration, border control or courts), emergencies, safety instructions, and money or contracts. In those situations, use a qualified human interpreter, and confirm anything important in another way.
3. Models and downloads
- Saymondo must download its models before it works: the translation engine (about 2.6 GB), a speech-recognition pack for each group of languages you use and, if you want it, the offline voice pack. Downloading everything takes about 5.6 GB of storage (the packs selected by default during setup, about 3.5 GB), and the translation engine's cache takes about 0.5 GB more.
- We host the files on our download site, files.saymondo.com, through a third-party provider (Cloudflare). We cannot promise that the files will stay available, or that they can be downloaded where you are.
- You are responsible for any data charges. The app asks before downloading over mobile data.
- The models are made by others and licensed under their own licenses (see section 6). By downloading a model, you accept its license.
4. Offline voice (Supertonic 3): use restrictions
This section applies if you download or use the optional offline voice pack. The license of the voice model requires it.
4.1 The offline voice pack contains the Supertonic 3 model by Supertone Inc. (the “Model”). It is licensed under the BigScience Open RAIL-M License dated August 18, 2022 (the “Voice License”). A full copy is in the app under Settings > About > Open-source licenses, and on the web with these terms at https://www.saymondo.com/terms. “Derivatives of the Model” has the meaning given in the Voice License.
4.2 You may download and use the voice pack only if you accept this section. In the app, you accept it by tapping Accept and download. Your right to use the voice pack depends on following this section.
4.3 You agree not to use the Model, Derivatives of the Model, or any speech they produce:
- (a) In any way that violates any applicable national, federal, state, local or international law or regulation;
- (b) For the purpose of exploiting, harming or attempting to exploit or harm minors in any way;
- (c) To generate or disseminate verifiably false information and/or content with the purpose of harming others;
- (d) To generate or disseminate personal identifiable information that can be used to harm an individual;
- (e) To generate or disseminate information and/or content (e.g. images, code, posts, articles), and place the information and/or content in any context (e.g. bot generating tweets) without expressly and intelligibly disclaiming that the information and/or content is machine generated;
- (f) To defame, disparage or otherwise harass others;
- (g) To impersonate or attempt to impersonate (e.g. deepfakes) others without their consent;
- (h) For fully automated decision making that adversely impacts an individual’s legal rights or otherwise creates or modifies a binding, enforceable obligation;
- (i) For any use intended to or which has the effect of discriminating against or harming individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics;
- (j) To exploit any of the vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behavior of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm;
- (k) For any use intended to or which has the effect of discriminating against individuals or groups based on legally protected characteristics or categories;
- (l) To provide medical advice and medical results interpretation;
- (m) To generate or disseminate information for the purpose to be used for administration of justice, law enforcement, immigration or asylum processes, such as predicting an individual will commit fraud/crime commitment (e.g. by text profiling, drawing causal relationships between assertions made in documents, indiscriminate and arbitrarily-targeted use).
4.4 Among other things, (l) and (m) mean that you must not use the offline voice to give medical advice or interpret medical results, or to generate or pass on information for use in the administration of justice, law enforcement, immigration or asylum processes. These restrictions apply to the offline voice pack only; section 2 applies to all of Saymondo.
4.5 Speech from the offline voice pack is machine-generated. While it plays, the app labels it on screen as a synthetic voice. If you record, publish or pass on speech made with it, you must clearly state that it is machine-generated.
4.6 If you give the voice pack files, or a Derivative of the Model, to anyone else, you must give them a copy of the Voice License and bind them to these same restrictions.
4.7 If you break this section, your right to use the voice pack ends immediately and you must delete it (in Settings, under Offline voice). We may update the voice pack to a newer version of the Model, or stop offering it.
4.8 This section continues to apply for as long as you keep or use the voice pack or speech made with it.
4.9 The Model is provided by its licensor “as is” (Voice License sections 9 and 10). Nothing in these terms is a promise made by Supertone Inc.
5. Acceptable use
You agree:
- to use Saymondo lawfully, and only with people who know that you are using a translation app; not to use it to listen in on anyone;
- not to use Saymondo, its translations or its speech to harass, threaten, defame, deceive or impersonate anyone;
- not to present its output as a certified or professional translation;
- not to break or get around the licenses of the models and components in Saymondo, including section 4;
- not to get around the limits of the free trial or the free sentences, the check of the subscription, or the check of Saymondo Pro from a Saymondo account, for example by modifying the app;
- not to share, sell, rent or transfer your Saymondo account or Saymondo Pro, except for the household use that section 10.13 allows, and not to get around the device limits in section 10.13;
- not to create Saymondo accounts automatically or in bulk, and not to try to get into an account that is not yours;
- not to sell Saymondo or distribute modified versions of it. Get Saymondo only from Google Play, the App Store or https://www.saymondo.com; copies from anywhere else may have been altered.
6. Third-party components and licenses
Saymondo includes open-source software, and it uses models and a typeface made by others. They are listed with their licenses and copyright notices in the app under Settings > About > Open-source licenses. Those licenses govern those components, and nothing in these terms limits the rights that those licenses give you.
Your phone's text-to-speech engine, the voices of iOS and iPadOS, Google Play, the App Store, Sign in with Google, Sign in with Apple where it is offered, and the download sites are provided by others under their own terms.
Apart from those components, Saymondo, including its name, design and code, belongs to us.
7. Changes to the app
We may change Saymondo at any time, for example by adding or removing features or languages, or by changing models or download sources, and we may stop offering it. Face-to-face translation in the version on your phone does not need any server of ours to work, but we do not promise to keep supporting or updating it. Section 10 explains how changes affect Saymondo Pro.
8. No warranty
Saymondo, with or without Saymondo Pro, is provided “as is” and “as available”. To the extent the law allows, we make no warranties of any kind, express or implied, including that the app or its output will be accurate, complete, uninterrupted, error-free or fit for a particular purpose.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for losses caused by relying on recognized text, translations or speech from the app, by models or our account server being unavailable, or by the data charges or storage that downloads use.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, for fraud, or for harm caused intentionally or through gross negligence. Nothing in these terms takes away rights you have as a consumer under the laws of the country where you live.
10. Free trial, free sentences and Saymondo Pro
10.1 You can use every feature of Saymondo free of charge for 3 days (72 hours). The trial starts when the first translation is completed, not when you install the app, and it needs no payment details and no account. Saymondo keeps track of the trial on the phone; if Android restores the app's data from a backup, the trial continues where it was. In the version from the App Store, the trial is also kept in the Keychain of iOS and iPadOS, which keeps it when the app is deleted, and it continues where it was after iOS or iPadOS restores the app's data from a backup. Each phone gets the trial once: reinstalling the app or clearing its storage does not start a new one. To check this, the app asks our server when it is online (the privacy policy explains what it sends); without an internet connection, the trial works as before. Signing in to a Saymondo account does not change the trial or the free sentences: they are always counted on each phone, never for an account.
10.2 After the trial, Saymondo translates up to 20 sentences a day free of charge. A sentence counts when its translation is completed, whichever of the two people spoke it. Recordings that are cancelled or too short, turns in which nothing was heard, and failed recognition or translation do not count; a failed sentence that you retry counts once, when it succeeds. Listening to a translation again, reading aloud and trying out voices do not count. The count starts again at midnight, local time on the phone (after a move to a time zone where it is earlier, at midnight in the time zone where that day's count began), and sentences you do not use do not carry over to the next day. A sentence that has already started is always finished, even if it goes over the limit. When the day's free sentences are used up, Saymondo does not translate new sentences until the next day, unless you subscribe.
10.3 Saymondo Pro is an optional subscription. While it is active, there is no daily limit, and you can choose the voices that read translations aloud, in versions that offer that choice. Everything else, including all languages, both conversation modes, model downloads and reading aloud with the automatic voice, is available with or without it. When Saymondo Pro ends, the voices you chose are kept but not used: translations are read with the automatic voice until you subscribe again.
10.4 In the version from Google Play, you buy Saymondo Pro through Google Play, and Google Play's terms and payment rules apply to the purchase. Before you confirm, the app and Google Play show the price and the billing period (for example monthly or yearly). Prices are set in Google Play and can differ between countries. While Google Play is still processing a payment, Saymondo Pro is not yet active. A subscription belongs to the Google account it was bought with: on another phone or after reinstalling the app, sign in to Google Play with that account, and Saymondo finds the subscription. If you are signed in to a Saymondo account, the subscription can also be linked to that account and used on your other devices (10.12). In the version from the App Store, 10.15 to 10.17 apply in place of 10.4, 10.5, 10.7 and 10.8.
10.5 A subscription renews automatically at the end of each billing period, and Google Play charges the price of the next period, until you cancel it. You can cancel at any time in Google Play; the app's settings link to it. Uninstalling Saymondo does not cancel a subscription. After you cancel, Saymondo Pro stays active until the end of the period you have paid for and then ends, and the free sentences apply again. If a renewal payment fails, Saymondo Pro may stop until the payment is sorted out in Google Play.
10.6 Saymondo asks Google Play about your subscription when it starts, when you return to it and when you open the subscription page. This check may need an internet connection; translation does not. If Google Play cannot answer, Saymondo keeps treating the subscription as active for up to 7 days after it was last confirmed; after that, the free sentences apply until Google Play answers again. Saymondo Pro that a device receives through a Saymondo account works offline as described in 10.14.
10.7 Refunds are handled under Google Play's refund policies. You can ask Google Play for a refund, or write to us (section 17). This does not limit any right to a refund that the law gives you.
10.8 We may change the price of Saymondo Pro. If the price of your subscription goes up, Google Play tells you in advance, and you can cancel before the new price applies. Where the law or Google Play requires your agreement, the subscription does not renew at the new price unless you accept it. A price change never applies to a period you have already paid for.
10.9 We may change the length of the trial, the number of free sentences and what Saymondo Pro includes, with a new version of the app and of these terms. A change never takes anything away from Saymondo Pro during a period you have already paid for. If we stop offering Saymondo Pro, it does not renew again.
10.10 The version downloaded from https://www.saymondo.com has the same free trial and free sentences. At present Saymondo Pro cannot be bought in it, but if your Saymondo account has Saymondo Pro, for example a Google Play subscription linked to it (10.12), you can sign in to the account in this version and use Saymondo Pro there; a device with this version always counts towards the limits in 10.13. Its button for subscribing only opens Saymondo's page in Google Play, where you can get the version from Google Play instead (you may first need to uninstall the version from the website, and then download the models again). If your phone has no Google Play Store, you cannot buy Saymondo Pro on it at present. At present we accept payment for Saymondo only through Google Play and, in the version from the App Store, through the App Store.
10.11 Right of withdrawal for consumers in the European Union and the United Kingdom: If you are a consumer in the European Union or the United Kingdom, you may have a right to withdraw from a purchase of Saymondo Pro within 14 days without giving a reason. Saymondo Pro is sold through Google Play, so Google Play's terms and refund policies apply to how a withdrawal or refund is handled; you can also write to us at support@saymondo.com. Nothing in these terms limits a right of withdrawal you have under the law where you live.
10.12 You never need a Saymondo account to buy Saymondo Pro. If you are signed in to a Saymondo account when you buy it in Google Play, or sign in later on a phone where Google Play shows your subscription, Saymondo links the subscription to that account, and you can then use Saymondo Pro on your other devices where you sign in to the same account, within the limits in 10.13. A subscription is linked to one Saymondo account at a time. If it is already linked to another account, you can sign in to that account or merge the two accounts (11.4); if Google Play on the phone you are using confirms that you bought the subscription, you can also move it to the account you are signed in to, at most once every 30 days. Linking or moving a subscription does not change how it is paid for: it stays a Google Play subscription under 10.4 to 10.8. We may also add Saymondo Pro to an account for a limited time, for example to make up for a problem; that time is free of charge, does not renew, ends by itself, and is used under 10.13 and 10.14.
10.13 Saymondo Pro that you use through a Saymondo account is for you and the members of your household, on at most 3 phones or tablets and 2 computers at the same time. Phones and tablets are counted separately from computers. A device counts once it receives Saymondo Pro through your account; a phone on which Google Play itself confirms your subscription, linked to your account, does not count. When a group is full and you want Saymondo Pro on another device, Saymondo asks you to choose a device to remove. Choosing a device to remove in this way, or removing a device that counts from the device list on another device while its group is full, counts as a replacement: you can make at most 3 replacements in any 30 days, for all devices together. Removing a device while its group is not full, and signing out on a device itself, free its place and are not replacements, and a device that has not connected to our server for 60 days no longer counts. A device that is removed returns to the free sentences when its Saymondo Pro would next have to be renewed (10.14); translation keeps working. We may change these limits only as 10.9 allows.
10.14 Saymondo Pro that a device receives through a Saymondo account works without an internet connection for up to 30 days after the device last renewed it, or until the paid time ends if that is earlier. Saymondo renews it in the background, at most once a day, when the app starts or you return to it while the device is signed in and online. If it is not renewed in time, the free sentences apply on that device until it renews again; translation never needs a connection. Changes to your Saymondo Pro, for example a cancelled or refunded subscription or a removed device, reach a device when it next renews. Turning the device's clock back does not extend Saymondo Pro.
10.15 In the version from the App Store, you buy Saymondo Pro through Apple's App Store with your Apple Account, and Apple's terms and payment rules, including the Apple Media Services Terms and Conditions, apply to the purchase. Payment is charged to your Apple Account when you confirm the purchase. Before you confirm, the app and the App Store show the price and the billing period (monthly or yearly). Prices are set in the App Store and can differ between countries and regions. While a purchase is waiting for approval, for example through Ask to Buy, Saymondo Pro is not yet active. A subscription belongs to the Apple Account it was bought with: on another iPhone or iPad, or after reinstalling the app, use the App Store with that Apple Account, and Saymondo finds the subscription; Restore purchases in the app asks the App Store again. Saymondo Pro cannot be shared through Family Sharing. Saymondo asks the App Store about your subscription as 10.6 describes for Google Play, with the same 7 days. If you are signed in to a Saymondo account, the subscription is linked to it as 10.12 describes, with the App Store in place of Google Play: it stays an App Store subscription under 10.15 to 10.17, and an iPhone or iPad on which the App Store itself confirms your subscription, linked to your account, does not count towards the limits in 10.13.
10.16 A subscription bought in the App Store renews automatically at the end of each billing period, and Apple charges the price of the next period to your Apple Account, until you cancel it. Apple may charge for the renewal up to 24 hours before the current period ends, so cancel at least 24 hours before then if you do not want it to renew. You can cancel at any time in the settings of your Apple Account (on iPhone or iPad: Settings > your name > Subscriptions); Manage subscription in Saymondo's settings opens that page. Deleting Saymondo does not cancel a subscription. After you cancel, Saymondo Pro stays active until the end of the period you have paid for and then ends, and the free sentences apply again. If a renewal payment fails, Saymondo Pro may stop until the payment is sorted out with Apple.
10.17 Refunds for App Store purchases are handled by Apple under its policies: you can ask Apple for a refund at https://reportaproblem.apple.com. We cannot refund App Store purchases ourselves, but you can write to us (section 17). If the price of your subscription goes up, Apple tells you in advance and, where its rules or the law require, asks for your agreement; a subscription does not renew at a higher price that needed your agreement and did not get it, and a price change never applies to a period you have already paid for. Saymondo Pro bought in the App Store is sold through the App Store, so Apple's terms and refund policies apply to how a withdrawal under 10.11 or a refund is handled. Nothing in these terms limits any right to a refund or withdrawal that the law gives you.
11. Saymondo account
11.1 A Saymondo account is optional. You do not need one to translate, to use the free trial or the free sentences, or to buy Saymondo Pro in Google Play or the App Store. It lets you use Saymondo Pro on your other devices (10.12 to 10.14). The privacy policy explains what information the account uses.
11.2 You can sign in with Google or with a one-time code sent to your email address and, in the version from the App Store and other versions of Saymondo that offer it, with Apple. Sign-ins that bring the same verified email address belong to the same account; an address from Apple's Hide My Email does not join accounts. You can add sign-in methods to your account and remove them, except the last one.
11.3 You are responsible for keeping your email account and your Google and Apple accounts secure: anyone who can sign in with them can use your Saymondo account. If you think someone else is using your account, remove the devices you do not recognize and write to us (section 17).
11.4 You can merge another Saymondo account that you can sign in to into the account you are signed in to. Its sign-in methods, linked subscriptions, devices and any remaining Saymondo Pro time move to your account, and the other account is closed. Saymondo shows both accounts before you confirm. A merge cannot be undone.
11.5 You can delete your account in the app (Settings > Account > Delete account) or at https://www.saymondo.com/account/delete. Deleting your account does not cancel a Google Play or App Store subscription; cancel it in Google Play (10.5) or in the settings of your Apple Account (10.16). The subscription is unlinked from the deleted account and can be linked to a new one. Saymondo Pro time that we added to the account (10.12) ends. Saymondo Pro already on a device keeps working until it would next have to be renewed, at most 30 days (10.14). Deleting an account cannot be undone.
11.6 We may suspend or close a Saymondo account that is used in breach of these terms, for example to share Saymondo Pro beyond 10.13, to resell it, or to attack our service. Unless the law, security or serious misuse requires otherwise, we will first write to the account's contact email address and give you a chance to respond. While an account is suspended, it cannot be used to sign in or to get Saymondo Pro; translation, the free trial, the free sentences and the store's own check of a subscription on a phone (Google Play or the App Store) keep working. Closing an account does not cancel a Google Play or App Store subscription linked to it: it keeps working on phones where that store confirms it, and you can cancel it, or ask for a refund, in that store under its rules (10.5, 10.7, 10.16, 10.17).
11.7 Our account server may sometimes be unavailable. Translation never needs it, and Saymondo Pro already on a device keeps working for the period in 10.14. If we stop offering Saymondo accounts, we will announce it in the app and on https://www.saymondo.com at least 30 days in advance; Google Play and App Store subscriptions keep working on phones where the store confirms them.
12. Ending
You can stop using Saymondo at any time by uninstalling it; this does not cancel a subscription (sections 10.5 and 10.16) or delete your Saymondo account (section 11.5). If you break these terms, your right to use Saymondo, including the offline voice and a Saymondo account, ends. Sections 2, 4, 8, 9 and 14 continue to apply after that.
13. Changes to these terms
We may update these terms. The new version will be at https://www.saymondo.com/terms and in the app, with a new effective date. We will mention significant changes in the release notes and, where the app needs your agreement again (for example for the offline voice), ask for it in the app. If you keep using Saymondo after a change takes effect, the new terms apply to you.
14. Governing law and disputes
These terms are governed by the laws of the place where Cloud of Star Co., Ltd. is registered. If you have a problem with Saymondo, please contact us first so that we can try to solve it. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts where the law allows.
15. General
These terms, together with the privacy policy, the licenses in section 6 and, for the version from the App Store, the Standard EULA (section 16), are the whole agreement between you and us about Saymondo. If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a part right away, we can still enforce it later.
These terms are written in English. If a translation differs, the English version applies.
16. Version from the App Store
The license to use the version of Saymondo from Apple's App Store is Apple's Licensed Application End User License Agreement (the “Standard EULA”), at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These terms of use also apply to that version and govern Saymondo's own service, including the free trial and the free sentences, Saymondo Pro, Saymondo accounts and the terms of the offline voice pack in section 4. Where these terms and the Standard EULA conflict about the license to use the app, the Standard EULA prevails.
